Sejumlah LSM yang tergabung dalam Koalisi Pemantau Peradilan (KPP) melaporkan majelis Peninjauan Kembali (PK) yang mengabulkan PK Sudjiono Timan ke Komisi Yudisial (KY). Tak hanya majelis PK, KPP juga melaporkan salah satu majelis hakim Pengadilan Negeri (PN) Jakarta Selatan terkait masalah tersebut. Total ada 5 majelis hakim yang diadukan.

"Kami melaporkan majelis hakim baik PN sampai MA," kata Koordinator Indonesian Legal Roundtable (ILR), Erwin Natosmal Oemar di Gedung KY, Jakarta, Jumat (30/8/2013).

Majelis PK yang dilaporkan yakni Hakim Agung Suhadi, Hakim Agung Andi Samsan Nganro, Hakim Ad Hoc Tipikor Abdul Latief, dan Hakim Ad Hoc Sofyan Marthabaya. Sedangkan hakim PN Jakarta Selatan yang dilaporkan adalah Soehartono.

Menurut Erwin, ada pelanggaran kode etik yang dilakukan majelis PK dan hakim PN Jakarta Selatan tersebut. Dalam konteks ini, lanjut Erwin, KY berwenang memeriksa mereka terkait putusan PK yang akhirnya membebaskan Sudjiono, terpidana korupsi dana Bantuan Likuiditas Bank Indonesia (BLBI).

"Pada prakteknya, kasus (PK Sudjiono) itu kan terjadi. KY pun berwenang memeriksa hakim, baik PN dan MA," kata dia.

Komisioner KY sekaligus Ketua Tim Panel Investigasi, Taufiqqurahman Sahuri mengatakan, KY memberikan apresiasi terhadap laporan ini. "Laporan KPP ini bisa menjadi laporan dari masyarakat. KY sudah bergerak," kata Taufiq.

Taufiq menjelaskan, KY akan menelusuri laporan KPP ini. Meski sebelum ada laporan ini KY sudah lebih dulu bergerak.

"Ada prosedur yang diduga hakim melanggar hukum acara. Dan putusan (PK) ini aneh, orang yang melecehkan kehormatan hakim kok diterima PK-nya sama hakim. Harusnya hakim tersinggung," kata Taufiq.

Sebelumnya, Mahkamah Agung (MA) mengabulkan permohonan Peninjauan Kembali (PK) yang diajukan Sudjiono Timan. Padahal koruptor dana Bantuan Likuiditas Bank Indonesia (BLBI) itu dalam tingkat kasasi oleh MA divonis 15 tahun penjara.

Perkara yang diketok pada 13 Juli 2013 ini ditangani oleh majelis PK yang diketuai Hakim Agung Suhadi dengan anggota Sophian Martabaya dan Andi Samsan Nganro serta 2 hakim adhoc Tipikor.

Sudjiono Timan adalah Direktur Utama PT Bahana Pembinaan Usaha Indonesia (BPUI). Dalam perkara korupsi Bantuan Likuiditas Bank Indonesia (BLBI), Sudjiono dinilai telah merugikan Negara sebesar US$ 120 juta dan Rp 98,7 juta. (Ein/Ism)
