Anggota Komisi Hukum Nasional (KHN), Frans Hendra Winarta, ikut mengomentari putusan peninjauan kembali (PK) yang diajukan Sudjiono Timan, koruptor dana Bantuan Likuiditas Bank Indonesia (BLBI). Menurut Frans, harus ada perbaikan dari sisi pengawasan, baik internal maupun eksternal Mahkamah Agung (MA).

"Selalu (pengawasan) dari dalam pasti ada resistensi. Pengawasan ini yang harus diperbaiki. Bagaimana mau pengawasan sempurna kalau eksternal dan internal tidak bisa kerja sama?" tanya Frans di Gedung KHN, Menteng, Jakarta, Rabu (3/9/2013).

Namun, menurut Frans, ada yang lebih penting dari pengawasan. Yakni perubahan dengan dilakukannya reformasi di internal MA. Salah satu yang perlu diperhatikan adalah adanya perubahan kesejahteraan hakim agung. "Di negara lain hakim agungnya pasti digaji tinggi. Apalagi ada keluhan gaji hakim agung lebih rendah dari hakim tinggi. Itu saja sudah tidak fair," kata dia.

DEalam membuat putusan, lanjut Frans, hakim agung juga harus melihat dampak sosial yang bisa terbentuk akibat putusan itu. "Jadi kalau ada gangguan dari luar itu bisa mereka pikir. Apakah mau ditulis dengan tinta emas, atau dipampang di MA selamanya, atau kaya raya tapi kepalanya dipenggal," kata Frans.

Frans memastikan akan banyak hakim agung yang memilih putusan dengan tinta emas. "Dan saya yakin banyak hakim agung yang memilih pilihan pertama, tinta emas, dan namanya dihormati sepanjang masa. Tapi dengan gaji mereka yang sekarang, sangat rawan di iming-iming," ucapnya.

Seperti diberitakan sebelumnya, MA mengabulkan permohonan PK yang diajukan Sudjiono Timan. Padahal, koruptor dana BLBI itu dalam tingkat kasasi oleh MA divonis 15 tahun penjara.

Sudjiono Timan adalah Direktur Utama PT Bahana Pembinaan Usaha Indonesia (BPUI). Dalam perkara korupsi BLBI, Sudjiono dinilai telah merugikan negara sebesar US$ 120 juta dan Rp 98,7 juta. (Ado/Ism)
